Just start a socail network mlm and need to know is it legal?

hi, i just start my social network mlm and need some advise on legal issue.

my social notwork are similar to facebook and you can earn money without to upgrade and pay anything, to make money.

when you refer someone to the website and your referral upgrade to membership to gain premium access feature on the site. and you can still earn money.

you earn 12 percent ad a free register user. if you upgrade to gold you can earn up to 36 percent as a vip member.

does this make my social network mlm legal?
